นโยบายการให้บริการชื่อโดเมนภาษาไทย ภายใต้ .th

THNIC จะเปิดให้จดทะเบียนชื่อโดเมนภาษาไทย ภายใต้โดเมนระดับบนสุด (Top Level Domain) .th
ตั้งแต่วันที่ 26 กรกฎาคม 2547 เป็นต้นไป โดยมีเงื่อนไขดังนี้
(* หมายเหตุ ผู้ประสงค์จะจดทะเบียนชื่อโดเมนภาษาไทยระหว่างวันที่ 26 กรกฎาคม – วันที่ 25 ตุลาคม 2547 กรุณาตรวจสอบ บทเฉพาะกาล ก่อนการลงทะเบียนตั้งแต่ข้อ 15 เป็นต้นไป)

ทั่วไป

1. สำหรับผู้ถือครองชื่อโดเมนภาษาอังกฤษใด ๆ ภายใต้ .th อยู่ก่อนแล้วเท่านั้น และชื่อโดเมนภาษาอังกฤษ 1 ชื่อ จะสามารถใช้อ้างอิงเพื่อจดทะเบียนชื่อโดเมนภาษาไทยได้ 1 ชื่อเท่านั้น

2. บริการชื่อโดเมนภาษาไทยนี้ถือเป็นบริการเสริม และไม่มีค่าใช้จ่ายแต่อย่างใด จนกว่าจะมีการประกาศเปลี่ยนแปลง ซึ่ง THNIC ขอสงวนสิทธิ์ในการเปลี่ยนแปลงนโยบายด้านค่าใช้จ่ายในบริการนี้

3. การขอจดทะเบียนชื่อโดเมนภาษาไทยจะสามารถกระทำได้ในกรณีที่ไม่มีรายการค้างชำระใด ๆ อันเกี่ยวเนื่องกับชื่อโดเมนภาษาอังกฤษที่อ้างอิง รวมถึงชื่อโดเมนภาษาอังกฤษต้องไม่อยู่ในสถานะที่ถูกเพิกถอน ถูกอายัด หรืออยู่ในระหว่างการพิจารณาเพื่อแก้ปัญหาข้อขัดแย้งใด ๆ

การยกเลิก

4. ชื่อโดเมนภาษาไทยจะถูกยกเลิกอัตโนมัติเมื่อชื่อโดเมนภาษาอังกฤษถูกยกเลิกไม่ว่าจะด้วยกรณีใด

5. การขอยกเลิกชื่อโดเมนภาษาไทย สามารถกระทำได้โดยการส่งคำร้องด้วยแบบฟอร์มที่ทาง THNIC ได้จัดเตรียมไว้ให้บนหน้าเว็บ หรือส่งหนังสือลงลายมือชื่อของผู้ดูแลด้านบริหาร (Administrative Contact) หรือผู้มีอำนาจของหน่วยงานที่ถือครองชื่อโดเมนภาษาอังกฤษที่อ้างอิงมายัง THNIC

การเลือกใช้ชื่อ

6. ชื่อโดเมนภาษาไทยจะต้องเป็นไปตามเงื่อนไขดังต่อไปนี้

• 6.1 ต้องไม่เกี่ยวข้องกับพระมหากษัตริย์ พระราชวงศ์ พระบรมวงศานุวงศ์ และสถานที่ที่เกี่ยวข้องกับพระมหากษัตริย์ พระราชวงศ์ และพระบรมวงศานุวงศ์
• 6.2 ต้องไม่ก่อให้เกิดความเสื่อมเสียชื่อเสียงแก่ผู้หนึ่งผู้ใด หรือองค์กรหนึ่งองค์กรใด
• 6.3 ต้องไม่เป็นชื่อต่าง ๆ ของประเทศไทย จังหวัด รวมถึงสถานที่อันเป็นสาธารณะต่าง ๆ ในประเทศ
• 6.4 ต้องไม่ประกอบด้วยคำหยาบหรือคำที่ผิดต่อศีลธรรมอันดีงามของไทย
• 6.5 จะต้องมีความสัมพันธ์อย่างหนึ่งอย่างใดกับชื่อโดเมนภาษาอังกฤษที่อ้างอิงดังนี้
• 6.5.1 อ่านออกเสียงได้ตรงกัน
• 6.5.2 มีความหมายตรงกัน

* ข้อยกเว้น หากท่านจดทะเบียนชื่อโดเมนภาษาอังกฤษจากชื่อบริษัท/หน่วยงาน/องค์กร ภาษาอังกฤษ ท่านสามารถจองชื่อโดเมนภาษาไทยจากชื่อบริษัท/หน่วยงาน/องค์กร ภาษาไทย ในกรณีที่เป็น บริษัท/หน่วยงาน/องค์กรเดียวกันและชื่อบริษัทมี 2 ภาษาซึ่งไม่ตรงกัน

7. กรณีที่ชื่อโดเมนภาษาไทยที่ท่านต้องการมีผู้จดทะเบียนไว้ก่อนแล้วอย่างถูกต้องครบถ้วนตามเงื่อนไขข้างต้น ท่านยินดีที่จะเลี่ยงใช้ชื่ออื่นที่สอดคล้องตามเงื่อนไขเช่นเดียวกัน

8. THNIC สงวนสิทธิ์การพิจารณาอนุมัติชื่อโดเมนภาษาไทยในขั้นตอนสุดท้าย

ขั้นตอนการดำเนินการ

9. ท่านสามารถตรวจสอบที่หน้าเว็บไซต์ของ THNIC เพื่อเข้าสู่ระบบจดทะเบียนชื่อโดเมนภาษาไทย ซึ่งจะเริ่มให้บริการตั้งแต่วันที่ 26 กรกฎาคม 2547

10. ท่านยินดีที่จะส่งเอกสารเพิ่มเติมในกรณีที่มีการร้องขอ ตามวิธีการที่จะแจ้งให้ทราบในขั้นตอนการจดทะเบียน ทั้งนี้เพื่อประกอบการพิจารณา ซึ่งท่านจะต้องกระทำให้แล้วเสร็จภายใน 3 วันทำการหลังจากท่านได้รับคำร้องขอ มิเช่นนั้นคำขอของท่านจะถูกยกเลิกโดยไม่แจ้งให้ทราบล่วงหน้า

11. THNIC จะแจ้งให้ท่านทราบว่าโดเมนภาษาไทยของท่านจดทะเบียนสำเร็จหรือไม่ ทางอีเมล์ภายใน 3 วันทำการหลังจากได้รับคำขอจดทะเบียนหรือได้รับเอกสารเพื่อใช้ประกอบการพิจารณาครบถ้วน

12. THNIC ถือเอาวันและเวลาที่ได้รับแบบฟอร์มเป็นหลักในการพิจารณาตามลำดับก่อนหลัง ในกรณีที่มีผู้ขอจองชื่อตรงกันในเวลาใกล้เคียงกัน

13. ท่านสามารถโต้แย้งคำพิจารณาของเจ้าหน้าที่ได้ ในกรณีที่ชื่อโดเมนภาษาไทยของท่านไม่ได้รับการจอง โดยจะต้องมีเหตุผลอันควร ซึ่งทางเจ้าหน้าที่จะส่งต่อให้คณะกรรมการวางนโยบายศูนย์สารสนเทศเครือข่ายประเทศไทยพิจารณา และคำตัดสินของคณะกรรมการฯ ถือเป็นที่สิ้นสุด

บทเฉพาะกาล

14. บทเฉพาะกาลมีผลบังคับใช้ตั้งแต่วันที่ 26 กรกฎาคม ถึงวันที่ 25 ตุลาคม 2547

15. ผู้ที่ขอจดทะเบียนชื่อโดเมนภาษาไทยในระยะเวลาของบทเฉพาะกาล จะต้องมีโดเมนภาษาอังกฤษซึ่งจดทะเบียนเรียบร้อยแล้วก่อนวันที่ 25 มิถุนายน 2547 เท่านั้น

16. ผู้ที่จดทะเบียนชื่อโดเมนภาษาอังกฤษตั้งแต่วันที่ 25 มิถุนายน 2547 เป็นต้นไป จะสามารถขอจดทะเบียนชื่อภาษาไทยได้ตั้งแต่วันที่ 26 ตุลาคม 2547 เป็นต้นไป

อื่น ๆ

17. เงื่อนไขอื่นใดที่ไม่ได้กล่าวไว้ ณ ที่นี้ ให้ถือเงื่อนไขตามนโยบายและขั้นตอนของ THNIC ตามที่แสดงไว้ที่ https://localhost/policy เป็นหลัก

18. THNIC ขอสงวนสิทธิ์ในการเปลี่ยนแปลงนโยบายการให้บริการชื่อโดเมนภาษาไทยโดยมิต้องมีการแจ้งให้ทราบล่วงหน้า

Policies on services of Thai domain name registration under .th

THNIC offers services of registration Thai domain name under .th starting on 26 July 2004 under the following terms and conditions.
(* Remark: Any entity who demand Thai domain name registration during 26 July to 25 October 2004 should have examined Temporary Provisions from article 15 so on before registering. )

General

1. Only for any domain name holder who had already registered English domain name under .th before and only one English domain name can be referred to one Thai domain name.

2. Thai domain name registration service is add-on service and free of any charge until there is any alteration issued which THNIC

3. Thai domain name registration must refer to only the English domain name that is not in debt of any fee and situation that can be terminated, captured, or in dispute settlement procedure.

Cancellation

4. Thai domain name will be terminated automatically when the referred English domain name is terminate, in any circumstance.

5. A request for Thai domain name registration can be conducted by submitting the form that is provided by THNIC on the web page or sending a copy of letter from Administrative Contact or a person in charge of an organization which is the English domain name holder via fax through THNIC.

Choice of Name

6. The name of the domain in Thai must comply with the following conditions.

• 6.1 Must not be relevant to his majesty, royal family and royalties or the place that connects with his majesty, royal family and royalties.
• 6.2 Must not offend any person’s or organization reputation.
• 6.3 Must not be a name of any country, any name of the Kingdom of Thailand, a province of Thailand and also national public domain.
• 6.4 Must not be combined with rude or immoral words.
• 6.5 Must be relevant to the English domain name which is referred to as followings.
• 6.5.1 Has the same pronunciation.
• 6.5.2 Has the same meaning.

* Exemption: If your registered English domain name is derived from the English name of a company/institute/organization you can register your Thai domain name by the Thai name of your company/institute/organization even the names from each language don’t have the same pronunciations or meanings.

7. In the case of your requested domain name has already rightful registered by other, you are willing to register another name that complies with the same conditions.

8. THNIC has privilege to consider and decide the final state of Thai domain name.

Procedure

9. You can examine THNIC website at http://localhost/idn/ for engaging in Thai domain name registration which open on 26 July 2004.

10. You are willing to submit requested document in addition by the method that is notified during the process

11. THNIC will notify you whether your Thai domain name is completely registered or not via e-mail in 3 working days after we received domain name registration request and all additional document into our consideration.

12. THNIC deems the date and time of receiving application form to consider priority in the case that more than one person request for the same domain registration

13. You can complain THNIC Staff decision, in the case that your Thai domain name registration is not accepted, by providing sufficient reason. THNIC Staff will process your complain to THNIC Committee and the committee decision is deemed ultimate.

Temporary Provisions

14. Temporary Provisions shall be effective during 26 July to 25 October 2004.

15. Thai domain name applicant in duration of Temporary Provisions must already registered English domain name only before 25 June 2004.

16. One who registered English domain name on 25 June 2004 and later shall be able to apply for Thai domain name from 26 October 2004 and so on.

Miscellaneous

17. Other term and condition that is not described here shall be derived from THNIC Policies which is described at http://localhost/index.php?page=policy

18. THNIC THNIC has privilege of altering policy for Thai domain name registration without prior notification.
